CreamAML / GIIF software version 2018 is new application version used for analysis and transactions reporting. It has been launched in connection with the Anti-Money Laundering and Terrorist Financing Act of 1 March 2018.

CreamAML is an electronic form of Transaction Register intended for people obliged to keep such a register and reporting transaction.

Software has embedded analyzer which allows for build transaction report depending on their types.

  1. domestic banks, branches of international banks, branches of credit institutions, financial institutions based in Poland and branches of financial institutions not domiciled in Poland within the meaning of the Act on Banking Law of 29 of August 1997
  2. cooperative savings and credit unions and National Cooperative Savings and Credit Union, within the meaning of the Act on Cooperative Savings and Credit Unions of 5 of November 2009
  3. national payment institutions, national electronic money institutions, branches of EU payment institutions, branches of EU and foreign electronic money institutions, payment service offices and paying agents, within the meaning of the Act on Payment Services of 19 August 2011
  4. investment companies, custodian banks in the meaning of the Act on Trading in Financial Instruments of 29 of July 2005 and branches of foreign investment companies
  5. foreign legal entities conducting brokerage activities on the territory of Poland, including those conducting such activities in the form of a branch, and commodity brokerage houses in the meaning of Commodity Exchanges Act of 26 of October 2000, and also commercial companies
  6. regulated market companies – in the extent that they operate an auction platform in the meaning of Act on Trading in Financial Instrument of 29 of July 2005
  7. investment funds, alternative investment companies, investment fund companies, ASI managers, branches of management companies in Poland and also branches from UE in Poland in the meaning of Act on Investment Funds and Alternative Investment Fund Managers of 27 of May 2004
  8. insurance companies carrying out activities in the meaning of Act on Insurance and Reinsurance of 11 of September 2015, including national insurance companies, main branches of foreign insurance companies with headquarters in a non-EU Member State and branches of foreign insurance companies domiciled in a country other than Poland (but in Member State of the European Union)
  9. insurance brokers performing activities in the field of listed insurance in the meaning of Act on insurance and reinsurance of 11 of September 2015 and branches of foreign brokers performing such activities based in Poland (excluding an insurance agent who does not collect insurance premiums from the client or the insurance company on the amounts due to the client)
  10. The National Depository for Securities S.A. and the company whose National Depository for Securities S.A. delegated the performance of activities to the extent that they keep securities accounts or omnibus accounts in the meaning of Act on Trading in Financial Instruments of 29 of July 2005
  11. entrepreneurs conducting currency exchange activities and other entrepreneurs providing a currency exchange service or a brokerage service, not being an obligated institution, and branches of foreign entrepreneurs conducting such activity in Poland in the meaning of Act on Foreign Exchange Law of 27 of July 2002
  12. entities conducting economic activity consisting in the provision of services in the field of:
    • exchanges between virtual currencies and means of payment
    • exchanges between virtual currencies
    • exchange brokerage
    • keeping bills
  13. notaries in the scope of activities carried out in the form of a notarial deed, including:
    • transfer of ownership of assets, including the sale, exchange or donation of movable or immovable property
    • conclusion of an inheritance agreement, termination of joint ownership, life imprisonment, and annuity in exchange for the transfer of ownership of real estate and for the division of joint property
    • transfer of the cooperative ownership right to the premises, perpetual usufruct right and the prospect of separate ownership of the premises
    • making a non-cash contribution after establishing the company
    • conclusion of an agreement documenting the contribution or increase of contributions to the company or the contribution or increase of the share capital
    • transformation or merger of companies
    • sale of the enterprise
    • disposal of shares in a company
  14. attorneys, legal advisors, foreign lawyers, tax advisors to the extent that they provide legal assistance or tax consultancy to a client regarding:
    • the purchase or sale of real estate, an enterprise or an organized part of an enterprise
    • managing cash, financial instruments or other customer assets
    • concluding a contract for maintaining a bank account, a securities account, or performing activities related to maintaining these accounts
    • making a contribution to a capital company or increasing the share capital
    • creation, operation or management of capital companies or trusts except of legal advisers and foreign lawyers in the meaning of Act on Legal Advisors and Tax Advisors of 6 of July 1982 (details – 5 of July 1996, Act on Tax Consultancy)
  15. tax advisers in the field of tax advisory services other than those listed in item 14 and statutory auditors
  16. entrepreneurs who are not other obligated institutions in the meaning of Act on the Freedom of Economic Activity of 2 of July 2004. they provide services consisting of:
    • creating a legal person or an organizational unit without legal personality
    • performing the function of a board member or enabling another person to perform this function or a similar function in a legal person or an organizational unit without legal personality
    • providing the registered office, business address or correspondence address and other related services to a legal person or an organizational unit without legal personality
    • acting or enabling another person to act as a trustee of a trust that was established by legal action
    • acting or enabling another person to act as a person exercising rights from shares or stocks to an entity other than a company listed on a regulated market subject to disclosure requirements in accordance with European Union law or subject to equivalent international standards
  17. entities conducting activities in the field of bookkeeping services
  18. real estate agents
  19. postal operators in the meaning of Act on Postal Law of 23 of November 2012
  20. entities operating in the field of games of chance, mutual wagering, card games and slot machine games in the meaning of Gambling Act of 19 of November 2009
  21. foundations, to the extent that they accept or make payments in cash equal to or exceeding the equivalent of EUR 10,000, regardless of whether the payment is carried out as a single operation or several operations that appear to be related. These foundation are created on basis of Act on Foundations (6 of April 1984)
  22. associations with legal personality, extent that they accept or make payments in cash equal to or exceeding EUR 10,000, regardless of whether the payment is carried out as a single operation or several operations that appear to be related. These associations are created on the basis of the Act of 7 April 1989 – Law on Associations
  23. entrepreneurs, to the extent that they accept or make payments for goods in cash with a value equal to or exceeding EUR 10,000 in the meaning of Act on the Freedom of Economic Activity of 2 of July 2004. This is whether the transaction is carried out as a single operation or several operations that appear to be related to each other
  24. entrepreneurs, to the extent that they carry out activities involving the provision of safe deposit boxes, and branches of foreign entrepreneurs conducting such activities in Poland in the meaning of Act on the freedom of economic activity of 2 of July 2004
  25. loan institutions in the meaning of Consumer Credit Act of 12 of May 2011
